Terms of Service

1. Acceptance of Terms
By accessing or using Material Radar (the "Service"), operated by Radar Quality Solutions LLC ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. If you are using the Service on behalf of an organization, you represent that you are authorized to accept these terms on that organization's behalf.
2. Description of Service
Material Radar is a cloud-based software platform that assists users in verifying Mill Test Reports (MTRs) against ASME/ASTM/API material specifications, managing material receiving inspection, and conducting dimensional inspections for pressure vessel fabrication shops.
The Service provides:
- MTR Verification — comparison of user-entered chemistry and mechanical values against specification tables with audit-ready PDF reports;
- Material Receiving — tracking of incoming material from delivery through full inspection, including heat numbers, tracer numbers, and storage locations;
- Dimensional Inspection — verification of dimensional measurements against material specifications for pipe, shell, head, plate, fitting, flange, forging, structural shapes, and other material types.
All inspections generate audit-ready records and PDF reports suitable for ASME quality program documentation.
3. Warranty Disclaimer
Warning: Material Radar is a verification aid only. Users are solely responsible for confirming specification values and making final material acceptance decisions. The final verification responsibility rests entirely on the licensed engineer, authorized inspector, or qualified quality control manager. Material Radar does not replace the professional judgment of a qualified inspector or the requirements of your quality program, applicable codes, or governing standards, including ASME Section VIII.
The Service is provided "as is" and "as available." Radar Quality Solutions LLC expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
4. Limitation of Liability
To the maximum extent permitted by law, Radar Quality Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or materials, arising out of or related to your use of — or inability to use — the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim arising out of these terms or the Service shall not exceed the greater of: (a) the fees you paid us for the Service in the trailing twelve (12) months; or (b) $50,000 USD.
The limitation above does not apply to:
- Gross negligence or willful misconduct;
- Breaches of confidentiality obligations;
- Indemnification obligations; or
- Any liability that cannot be limited or excluded under applicable law.
5. User Responsibility for Specification Accuracy
You are solely responsible for the accuracy of the data you enter, for confirming the applicable specification and revision, and for the final acceptance or rejection of any material. Verification results produced by the Service do not replace the judgment of a qualified inspector or the requirements of your quality program, applicable codes, or governing standards.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- Attempt to gain unauthorized access to the Service, other accounts, or its underlying systems;
- Interfere with or disrupt the integrity or performance of the Service;
- Reverse engineer, resell, or sublicense the Service except as expressly permitted; or
- Upload content that infringes the rights of any third party.
7. Subscriptions and Fees
Subscriptions are billed in advance, monthly or annually, at the price shown at the time of purchase. A one-time setup fee applies to new accounts and is charged once per organization at signup; it covers onboarding and the follow-up session described at the time of purchase. Promotional codes, where offered, apply only to the items they are issued against.
8. Cancellation Policy
You may cancel your subscription at any time. Upon cancellation you will retain full access through the end of your current billing period. We offer the following options before cancellation is finalized:
- Pause your subscription for 1–3 months;
- Downgrade from Pro to Lite; or
- Contact support for assistance.
After your billing period ends, your data will be available for download for 30 days before permanent deletion. Data hibernation options are available to extend this period.
9. Annual Subscriptions — Non-Refundable
Annual subscriptions are non-refundable. Upon cancellation of an annual subscription, you will retain full access to the Service through the end of the paid subscription period. No partial or prorated refunds will be issued for unused portions of an annual subscription term. Exception: if Radar Quality Solutions LLC cancels your account, a prorated refund will be issued for unused time.
10. Uptime
We target 99.5% monthly availability of the Service, excluding downtime caused by third-party infrastructure providers, scheduled maintenance, or events outside our reasonable control.
11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles.
