1. Acceptance of Terms
By accessing or using Material Radar (the "Service"), operated by Radar Quality Solutions LLC ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. If you are using the Service on behalf of an organization, you represent that you are authorized to accept these terms on that organization's behalf.
2. Description of Service
Material Radar is a software tool that assists users in verifying Mill Test Reports (MTRs) against ASME/ASTM material specifications. The Service compares user-entered chemistry and mechanical values against specification tables and generates audit reports reflecting those comparisons.
3. Warranty Disclaimer
Material Radar is a verification aid. Users are solely responsible for confirming specification values and making final material acceptance decisions. Radar Quality Solutions LLC makes no warranty that verification results are accurate or complete.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
4. Limitation of Liability
To the maximum extent permitted by law, Radar Quality Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or materials, arising out of or related to your use of — or inability to use — the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of these terms or the Service shall not exceed the amount you paid us for the Service in the twelve (12) months preceding the claim.
5. User Responsibility for Specification Accuracy
You are solely responsible for the accuracy of the data you enter, for confirming the applicable specification and revision, and for the final acceptance or rejection of any material. Verification results produced by the Service do not replace the judgment of a qualified inspector or the requirements of your quality program, applicable codes, or governing standards.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- Attempt to gain unauthorized access to the Service, other accounts, or its underlying systems;
- Interfere with or disrupt the integrity or performance of the Service;
- Reverse engineer, resell, or sublicense the Service except as expressly permitted; or
- Upload content that infringes the rights of any third party.
7. Uptime
We target 99.5% monthly availability of the Service, excluding downtime caused by third-party infrastructure providers, scheduled maintenance, or events outside our reasonable control.
8. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles.
